What You Can Appeal

You may have a right of appeal to the First-tier Tribunal (Immigration and Asylum Chamber) if the Home Office has refused to:

  • Grant asylum or humanitarian protection
  • Issue leave under the Family or Private Life route
  • Recognise your EU Settlement Scheme application
  • Allow your claim under Article 8 of the Human Rights Act
  • Extend or renew existing immigration status

Some decisions—such as Skilled Worker refusals—may not have a direct right of appeal, but can instead be challenged via administrative review or judicial review.

Appeal Procedures & Deadlines

Time is critical when appealing immigration decisions. If you are inside the UK, you typically have 14 calendar days to lodge your appeal. If you are outside the UK, the deadline is 28 calendar days from the date you receive your refusal decision.

The process involves:

  • Completing Form IAFT-1 or IAFT-2 depending on your case type
  • Submitting your appeal to the First-tier Tribunal along with supporting documentation
  • Preparing legal arguments and evidence to contest the Home Office decision
If you miss the deadline, you may need to apply for an extension with reasons. Late appeals are rarely accepted without exceptional circumstances.

Tribunal Structure & Next Steps

Once your appeal is lodged, the First-tier Tribunal will schedule a hearing. You may receive a ‘paper hearing’ or an ‘oral hearing’—the latter allowing you to attend and present your case in person.

The judge will consider:

  • Whether the Home Office made a lawful decision based on the evidence
  • Whether your rights under UK immigration law or the Human Rights Act were violated
  • The strength of your supporting documents and witness evidence

If the First-tier Tribunal dismisses your case, Haleys Solicitors can assist you with appealing to the Upper Tribunal based on legal error grounds.

Key Documents & Representation Strategy

Appeals often succeed or fail based on the evidence submitted. We help prepare:

  • Detailed witness statements
  • Expert reports (medical, social, or educational)
  • Updated identity and immigration status documents
  • Documentary proof of relationships, finances, and private life circumstances

Our in-house barristers also draft skeleton arguments, legal submissions, and rebuttals to the Home Office’s case. You will have full representation throughout all hearings, including guidance on cross-examination, interpreter requests, and safeguarding your rights in the courtroom.

Do You Meet The Minimum Requirements Of The Visa Type That You Want To Apply For?
Answer The Questions Below To Get Your Results.

Are you over the age of 18?

In the UK, a legal presumption exists that entitles anyone to enter into a contract unless an exception applies. One of those exceptions is in the case of a minor. Since 1969 the age of contractual capacity for individuals has been set at 18 and reaching the age of 18 is known as attaining 'majority'. Minors are therefore those who have not attained the age of 18.
